These Terms of Service ("Terms") govern your use of trackwell.eu and the purchase of digital products from us. By using the site or buying a product, you agree to these Terms.
1. Who we are
trackwell.eu is operated by Mészáros János e.v., a sole proprietorship based in Hungary; contact hello@trackwell.eu. The full statutory details are listed in our Imprint.
We supply printable digital health-tracking journals (PDF files) intended for personal use.
2. Merchant of record
All paid orders on trackwell.eu are sold by Paddle.com Market Limited (Judd House, 18-29 Mora Street, London EC1V 8BT, United Kingdom), which acts as the merchant of record. This means:
- Paddle is the seller of record for the transaction.
- Paddle collects payment, charges and remits EU VAT, and issues your invoice.
- Your contract for the purchase is with Paddle, governed by Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms).
- Mészáros János e.v. is the supplier of the digital content delivered through Paddle.
For payment, billing, refund and tax invoice questions, contact Paddle Support via your purchase receipt. For product, content and download questions, contact us directly at hello@trackwell.eu.
3. The products
Our products are PDF documents available for download in one or more languages. After payment is confirmed by Paddle, we send you a download link by email, valid for 7 days. The full product is also available via your Paddle order page.
4. License of use
When you purchase a single-language product, you receive a personal, non-exclusive, non-transferable license to:
- Print as many copies as you need for your own personal use.
- Print copies for your immediate household and dependents.
- Share an electronic copy with your treating physician or healthcare provider for the purpose of your own care.
You may not resell, redistribute, sublicense, or use our products for commercial training programs without our written permission. The "Complete Bundle" product additionally allows non-exclusive commercial use within a single clinical practice or translation business; contact hello@trackwell.eu for licensing beyond that scope.
5. Order, delivery, and price
Prices are displayed in euros (EUR) and may be converted to your local currency at checkout by Paddle. The price you see on the checkout page is the final price you pay; Paddle adds local VAT where applicable.
Delivery is instant: as soon as Paddle confirms your payment, our server sends a download email and the file is available for the next 7 days at the signed URL. If you do not receive the email within 10 minutes, check your spam folder, then contact hello@trackwell.eu.
6. Refunds
We offer a 14-day money-back guarantee on all paid digital products, regardless of EU rules that would otherwise allow us to deny refunds for digital content after download. See our Refund Policy for the exact procedure and the limited anti-abuse exceptions.
7. Intellectual property
All content of trackwell.eu and the PDF products — including layout, typography, illustrations (Wong-Baker face scale graphic, MIDAS questionnaire layout), text and translations — is the intellectual property of Mészáros János e.v. or its licensors and is protected by copyright. Clinical instruments cited (MIDAS, MOH criteria) are referenced under fair-use academic citation and remain the IP of their authors.
8. Medical disclaimer
Trackwell products are personal health-tracking tools. They are not medical devices. They do not diagnose, treat, cure or prevent any condition, and they do not replace professional medical advice. Always consult a qualified healthcare provider for medical questions.
The MIDAS questionnaire and MOH (medication-overuse headache) thresholds included in our migraine tracker are clinical screening tools, not diagnostic instruments. Their inclusion does not constitute medical advice.
9. Limitation of liability
To the fullest extent permitted by law, Mészáros János e.v.'s liability for any claim arising from your use of trackwell.eu or our products is limited to the amount you paid for the product. We are not liable for indirect, incidental, special, or consequential damages.
Nothing in these Terms limits your statutory consumer rights under EU law or your rights against Paddle as the merchant of record.
10. Governing law and disputes
These Terms are governed by Hungarian law, without prejudice to the mandatory consumer-protection provisions of the country in which you reside.
Disputes about the payment, billing or invoicing are governed by Paddle's own terms and the law applicable to Paddle.com Market Limited (England & Wales).
For online disputes, EU consumers can use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the site after a change constitutes acceptance of the new Terms.
